Cyber attack on the computer systems of the institutions of the Republic of Albania, the Prosecution Office requests 'House Arrest' for five IT employees

The Prosecution at the Court of First Instance in Tirana requests the security measure "House arrest" for five IT employees at the Department of Public Administration (DAP).

The request is made for the criminal offence of "Abuse of duty" provided for by Article 248 of the Criminal Code for the cyber attack on the state institution of the National Agency of ICT (AKSHI), which includes all official government websites in the Republic of Albania.

The employees in question were engaged in the IT position at DAP during the same time when the administratë.al system was implemented and maintained.

In the specific case, the IT staff at DAP could and should have requested a report from the economic operator contracted by DAP for the implementation and maintenance of the system in time regarding the situation in which this system was, despite the lack of knowledge about how to implement the contract for the implementation of the administrata.al system.

If these employees have acted in accordance with the instructions of the Information Security Regulation no. 337/1 of protocol, dated 17.01.2022, and the Internal Regulation of AKSHI by requesting information and updating with the latest antiviruses of the system, the virus that first entered administrata.al would have been discovered in their systems in order to make it possible to neutralize it without affecting the AKSHI system.  

The persons identified by the structures of AKSHI themselves, whose inactions have not made identification possible before, are:

A.I. - Specialist, IT Sector in the Department of Public Administration, Responsible, IT Sector in the Ministry of the Interior;

A.S. - Responsible, IT Sector in the Department of Public Administration, Responsible, IT Sector in the General Directorate of Prisons;

R.Ll. - Specialist, IT Sector in the Department of Public Administration;

I.L. - Specialist, IT Sector in the Department of Public Administration; and

A.Gj. - Specialist, IT Sector in the Department of Public Administration.

These persons with their inactions have brought serious consequences and have consumed the elements of the criminal offence of "Abuse of duty" provided for by Article 248 of the Criminal Code.

The prosecution office will continue the investigations for the full identification of any actor or subject involved in this activity, subjecting them to criminal liability.
