Kruje Prosecutor, Haxhi Giu, arrested over “passive corruption…”

Prosecution Office of Serious Crime has received the permission of the Court to arrest the citizen Haxhi Giu, with the function of “Prosecutor” at the Kruje District Prosecution Office, suspected on committing the offense “Passive corruption…of prosecutor…”, provided by Article 319/ç of the Criminal Code.

The decision of the Court for Serious Crimes has been executed by the State Police Forces.
Based on the investigation so far, concluded that the prosecutor Haxhi Giu, undertook, in exchange for a sum of money (euros), to reduce the conviction of the citizen Gjon Shpori, detained for “Manufacturing and selling narcotics” in 2014 along with some other people. The exact amount that was promised to the prosecutor will be the subject of further investigation.

While the case against Gjon Shpori and others was taking place in the District Court of Kruje, the brother of the accused, the citizen Aleks Shpori, in September 2015, contacted with the prosecutor of the case, Haxhi Giu and asked him, in exchange for a sum of money, to help Gjon to get out of prison.

The investigation concluded that the prosecutor Haxhi Giu has made it clear to the citizen Aleks Shpori that the procedural position of his brother was difficult and cannot help him. After the insistence of the citizen Aleks, the prosecutor appoints a meeting in Tirana, initially in a cafeteria and then they go together in a currency exchange. According to the investigation, at this currency exchange, the citizen Aleks deposits a sum of money, as a “guarantee” for the illegal service by the prosecutor.

Following this meeting, the prosecutor Haxhi Giu started to fulfill the corruptive demand of the citizen Shpori. The prosecutor Giu delivers an information to the General Prosecutor’s Office, according to which, based on the main elements of the investigation file, it should be reduced the procedural position of the citizen Gjon Shpuri, from the offense of “Manufacturing and selling narcotics” to “Failure to report a crime”.
The request of the prosecutor Giu was not accepted by the General Prosecutor’s office, which after considering the prosecutor’s request and the investigation material of the file, concluded that the citizen Gjon Shpori should be charged until the end of the  trial for the criminal offense of “Narcotics trafficking”, so with the same charges for which is judged  until now.
In these conditions, the prosecutor Giu followed the trial and at the end the citizen Gjon Shpori was sentenced to 8 years imprisonment for the offense of “Manufacturing and selling narcotics”.

After the verdict, the prosecutorof the case met again the citizen Aleks Shpori at the same currency exchange in Tirana, where reports that, despite concrete attempts, he cannot do anything to help Gjon. Meanwhile, the citizen Aleks Shpori withdrawn from the currency exchange the amount that he gave as “guarantee” and left without “paying” the prosecutor, as he did not reduce the charge of his brother.

Following the investigation, the Court for Serious Crimes, requested the security measure “detention in custody” for the citizen Haxhi Giu, with the function “prosecutor”, which was not accepted by the Court for Serious Crimes.
Also, at the request of the Prosecution Office of Serious Crimes, the Court decided security measure “detention in custody” for the citizen Aleks Shpori, suspected of the offense of “Active corruption of the judge, prosecutor…”, decision applied also by the State Police.
