The General Prosecution seeks authorization by the Parliament of Albania to arrest the MPs Tom Doshi and Mark Frroku

The General Prosecution seeks authorization by the Parliament of Albania to arrest the MPs Tom Doshi and Mark Frroku, based on Article 73/2 of the Constitution of the Republic of Albania.

The two MPs are suspected of consuming elements of the offenses; “False report”, “Intimidation to issue false statements, testimonies, expertise or interpretation” and “false declaration before the prosecutor”, provided by the Articles 305, 312/a and 305/a of the Criminal Code.

At the request sent to the Parliament, by the General Prosecutor, Mr. Adriatik Llalla, are explained the arguments against the two MPs. According to the request, the Prosecution Office for Serious Crimes, dated on 03/03/2015, has mainly recorded the criminal prosecution for "Murder of public officials" attempt, provided by Article 79/a - 22 of the Criminal Code, based on the statements of the MP Tom Doshi, who has publicly stated that he possessed evidence, according to which the Head of the Parliament, Ilir Meta, had paid a hit man to kill him and another deputy. On the same day, the Judicial Police at the General Directorate of the State Police has referred the materials in charge of the citizen Durim Bami, suspected of committing this offense.

In the context of the investigations for this criminal proceeding, there are asked people who may have been aware of the circumstances of the event, including some senior officials and Members of Parliament.
Based on the investigative actions, are raised reasonable doubts that the event publicly denounced by the deputy Doshi and proved by him before the Prosecution Office has been invented. None of the evidence collected up to this stage of the investigation, provided any concrete and reliable data on the organization of the murder of Tom Doshi, attempt.

On the other hand, the Prosecution Office, based on the evidences and findings of the investigation, has concluded that this event is staged by the citizens Tom Doshi, Mark Frroku and Durim Bami.

The Prosecution Office for Serious Crimes, having concluded that the event is staged by the citizens Tom Doshi and Mark Frroku, has passed the investigation’s competence to the General Prosecution Office, which has the legal empower on the investigation of the officials with the function of "MP". In the analysis that was done to the investigation’s material at the General Prosecution Office, it was concluded that the two MPs are suspected of consuming elements of the offenses; “False report”, “Intimidation to issue false statements, testimonies, expertise or interpretation” and “false declaration before the prosecutor”.
