The Prosecutor's Office at the Court of First Instance of Durrës General Jurisdiction has registered criminal proceedings no. 22 of 2021 against citizens M. I., M. K., H.H., A.M., D.Z., M. Sh., J.K., G.K. and M.T., suspected of committing of the criminal offences of "Abuse of duty carried out in collaboration" and " Non-reporting of Crime" provided for by Articles 248 and 25 and 300 of the Criminal Code. 

From the investigations it was found that in 2013, employees of the former Aluizni Durrës legalized several properties located in Xhafzotaj municipality, parts of which are built on a property which has an area of 2184 m2 and is categorized under the cadastral item "Road" with "state" legal status.

Also, employees of IMT Shijak, with their inaction, have consumed elements of the criminal offence of "Misuse of duty carried out in cooperation" provided for by Article 248 and 25 of the Criminal Code, as they took demolition decisions which have not been executed and they have not filed criminal reports in connection with the illegal constructions they found either.

The A.K. citizen with the duty of the Director of the board of the sewage company, has consumed the elements of the criminal offence of "Abuse of duty" as with the letter no. 158/1 dated 26.03.2015, he replied to the Directorate of Aluizi of Durrës, where he informed that the object of the citizen F.H., does not affect the objects, the drainage system that the Durrës-Kruje Drainage Board has in its inventory.

For the above, within the framework of the investigations of the above-mentioned proceedings, the Prosecution requested the First Instance Court of General Jurisdiction in Durrës, the appointment of security measures against the 9 citizens under investigation as follows. 

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided for respectively by Articles 242 and 233 of the Criminal Code against the citizen M.I., accused of committing the criminal offence provided for by Article 248 of 25 of the Criminal Code. 

•    "Suspension of exercising a duty or public service" provided for by Article 242 of the Criminal Code against the citizen M.K, suspected of committing the criminal offence provided for by Article 248 and 25 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided for respectively by Articles 242 and 233 of the Criminal Code against the citizen H.H. suspected of committing the criminal offence provided for by Article 248 and 25 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided for respectively by Articles 242 and 233 of the Criminal Code against the citizen A.M., suspected of committing the criminal offence provided for by Article 248 and 25 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided for respectively by Articles 242 and 233 of the Criminal Code against the citizen D.Z., suspected of committing the criminal offence provided for by Articles 248 and 25 of the Criminal Code.

•    "Suspension of exercising a duty or public service" provided for by Article 242 of the Criminal Code against the citizen M.Sh, suspected of committing the criminal offence provided for by Articles 248 and 25 and 300 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad", provided respectively by Articles 242 and 233 of the Criminal Code against the citizen J.K., previously unconvicted, suspected of committing the criminal offence provided for by Articles 248 and 25 and 300 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided for respectively by Articles 242 and 233 of the Criminal Code against the citizen G.K., suspected of committing the criminal offence provided for by Articles 248 and 25 of the Criminal Code.

•    "Suspension of exercising a duty or public service" and "Prohibition of going abroad" provided respectively by Articles 242 and 233 of the Criminal Code against the citizen M.T., suspected of committing the criminal offence provided for by Articles 248 and 25 and 300 of the Criminal Code.

With the decision dated 24.05.2023, the Court of First Instance of the General Jurisdiction of Durrës decided to confirm the coercive measure "Suspension of exercising a duty or public service" provided for by Article 242 of the Criminal Code, against citizens H.H., D.Z., M.SH. and G.K., to revoke the measure "Suspension of exercising a duty or public service" provided for by Article 242 of the Criminal Code, against the citizens M.K., M.I., J.K. and to pronounce inadmissible the requests for the citizens A.M. and M.T..
