At the request of the Prosecutor's Office at the Court of First Instance in Tirana, the security measure "Arrest in prison" was set for the citizen, A.GJ., Secretary General of the Ministry of Finance, the citizen F.H, Director of Support Services and Legal Affairs and the citizen A.R , a private bailiff as suspected of committing the criminal offense of "Abuse of Duty" provided for by Article 248 of the Criminal Code.

These citizens have acted by accepting the reward of citizen I. TH., in the amount of about 82,000,000 lek, of which ALL 50,000,000 transferred to the account of this citizen, treating him as the owner without being in this status, as well as executing for the second time a court decision executed by the Ministry of Finance in 2015. 

From the acts of criminal proceedings no. 8586/2022 registered in the Prosecutor's Office at the Court of First Instance of Tirana for the criminal offenses provided by articles 248 and 320 of the Criminal Code it resulted that:

Tirana Court of Appeal with its decision no. 16, dated 14.07.2000 has decided: "Order to solve the consequences for establishing the invalidity of the sales contract dated 23.04.1992 concluded between the sellers, the Directorate of Government Service, National Privatization Agency and the buyer I.Th, returning the parties to the previous situation, where the warehouse object no. 2 is returned to the Directorate of Government Service and the latter, together with the National Privatization Agency, returns to the buyer I.Th the value of the purchased objects (warehouse and land) which is ALL 103,046 converted with the index of the price increase at the time of execution of the decision".
The Ministry of Finance and Economy has executed the decision no. 9150 dated 12.11.1996 of the Court of the Judicial District of Tirana, upheld by the Court of Appeal, paying off the full obligation to the creditor I.Th., the value of the purchased buildings converted with the index of price increase, based on the information sent by the Publications Sector to INSTAT. 
Pursuant to the above decision, the amount of 284,139 was transferred from the Ministry of Finance to the accounts of I.Th. with a cost order no. 90 dated 27.02.2015. Further, it turns out that the citizen I. Th., addressed a bailiff office, which, in flagrant violation of the law, assessed, in 2022, the warehouse facility and the land for a total value of 145,867,920, assuming and treating the citizen I. Th., as a former owner at a time when he had never had this status. The entire value determined to be given to this citizen has been determined contrary to the law and it violates the state budget in about 1,200,000 euros.
Until this stage, it has turned out that the Ministry of Finance has transferred the amount of ALL 48,118,366 in favour of the citizen I. Th. From this amount, it is proven that ALL 25,000,000 have been trandferred in favour of the citizen Sh.P. 
The proceeding body finds and deems that there are doubts that the actions of the executor, the Ministry of Finance and other persons, have misused their duties by stealing from the budget of the state an amount of ALL 48,118,366 and have attempted to steal the remaining part. 
The prosecuting body has ordered the seizure of the amount transferred to citizen I. Th., and the bailiff's account, managing to seize about ALL 22,000,000 up to this stage of the investigation. 
The Prosecutor's Office at the Court of First Instance of Tirana has ordered the detention of citizen I.Th., for the criminal offenses provided by articles 134/3 and 320 of the Criminal Code.
