The Vlore Prosecutor's Office seizes 3996.5 m2 at Uji i Ftohte, worth 1.2 million euros; it was acquired with forged documents

First Instance, Vlore, registered the criminal complaint against citizen F.M. According to the documents, it appears that the complainant is one of the co-owners of the land property, with an area of 300m2, located in the "Uji i Ftohtë" neighbourhood, Vlore.

From the verifications carried out by the complainant, it was established that a part of his property that he had registered, was recognized as the property of other persons, who had acquired it through a judicial process. The property in question is located near the "New York" hotel, near the tourist area where the second part of the "Lungo Mare" project is being built in the city of Vlore.

It turns out that the document of origin on the basis of which the persons in question acquired the ownership of the above property, is the "transcription note" dated 4th April 1942, in favour of R.D., against the state treasury office, whose object is the purchase from him of a plot of land of 5 vreten (The mass of the earth's surface that is slightly larger than a dunam), against the value of 1200 gold francs, registered with no. 232/4, vol. 12, Article 104, page 106. From the verifications carried out by the complainant at various institutions such as ASHK (the State Agency of Cadastres) Vlore, it turned out that the above document does not exist, but according to the serial number there is only Article107 dated 14th April 1942 and Article 108 date 20th May 1942.
The complainant requested the initiation of criminal prosecution claiming that the above document could have been forged by the persons who had benefited from the above property.

From the investigations carried out after the registration of this criminal proceeding, from the analysis of the data administered for the needs of the investigation of this criminal proceeding; administration of relevant documentation; evidence related to the investigated fact; as well as the conclusions of the act of technical-graphic expertise carried out during the investigations, evaluating them in harmony and unity with each other, from our side as a proceeding body, we reach the conclusion that in this particular case we are facing the elements of the criminal offense of "Forgery of documents" and "Laundering the proceeds of a criminal offense or criminal activity", such criminal offenses provided by Articles 186/1 and 287 of the Criminal Code.

It is proven that the heirs of the citizen G.D., specifically the citizen A.D., forged the document "TRANSCRIPTION NOTE" dated 04.04.1942, in favour of R.D., against the state treasury office, compiled by notary A.A.", a document which according to the act of technical-graphic expertise no.12299 dated 07th October 2022 carried out by the Tirana Scientific Police Institute, it turned out to be completely falsified.
It was proven that the above forged document was used in administrative and judicial processes, specifically at the Tirana Property Handling Agency (2013); Vlore Court of First Instance (2016); Vlore Court of Appeal (2018) and it was the basic and main document that served for the recognition and return of the property which also dictated the Court's decision regarding the property subject to trial, with an area of 6480m2, of which 3996m2 was free, while the rest turned out to be busy with construction.

In addition to the falsification of this document, it was proven that after the court decisions that decided the recognition and return of the property, the property was registered in the real estate registers at ASHK Vlore, with no. 43/189/1 property, CZ. 8602, vol. .95, page 247, with an area of 3996.5m2.
Further, legal actions were carried out on this property with the aim of hiding/covering up the illegal nature of the property obtained by means of forged documents.
In the function of this criminal proceeding, the Court of First Instance Vlore requested that the property insurance measure "Preventive Sequestration" be assigned, related to the above property, which was registered at ASHK Vlore on the basis of the use of a forged document.

Upon the decision no. 478 of Act dated 03rd November 2022, the Court of the Judicial District of Vlore, has accepted the request submitted by the Prosecution Office at the Court of First Instance of Vlore, imposing the property security measure of preventive seizure for the property no. 43/189/1, CZ 8602, vol.95, page 247, with an area of 3996.5m2, located in the Uji i Ftohte neighbourhood, Vlore.
The value of the seized property, according to calculations based on market prices, reaches the figure of Euro 1,200,000.

In connection with this criminal proceeding, the name of the person attributed to the commission of the criminal offense provided for by Articles 186/1 and 287 letters (a) and (c) of the Criminal Code, thecitizen A.D., has been entered in the register of the criminal offense notifications.
