The explosion of the storehouse in Lushnje; Fier Prosecution Office declares the lack of subject-matter jursdiction. One individual is arrested and security measures against 5(five) individuals are imposed

On March 3, 2024, Fier Prosecution Office recorded the criminal case No. 358, concerning the criminal offenses " Breach of safety rules at work," "Illegal construction," " Abuse of office," and " Destruction of property due to negligence," provided for in articles 289 para. 2, 199/a para. 4, 248, and 161 of the Penal Code.
This criminal case was recorded for the incident occurring on  March 1, 2023, around 15:30, in the neighborhood "Karbunarë e Poshtme," Administrative Unit No.5, Lushnjë. As a result of a powerful explosion during the construction work on the "warehouse" building that belongs to the citizen B.Ç.,  two people lost their lives, and seven others were injured.
Procedural actions have been carried out by the judicial police under the direction of stand-by duty  prosecutors who were present at the scene, such as inspecting the scene, conducting technical construction expertise, seizing and examining documents, questioning numerous individuals, and other investigative actions related to the nature of the incident.
After administering the above-mentioned data and cross-referencing them,  Fier Prosecution Office has recorded the names of the 7 (seven) individuals implicated in the criminal offenses, delineated as follows:
-Citizen B.Ç. for the criminal offenses " Breach of safety rules at work,", "Illegal construction," and " Destruction of property due to negligence," as stipulated in articles 289 para. 2, 199/a para. 4, and 161 of the Penal Code.
-Citizen L.Gj. for the criminal offense " Breach of safety rules at work," as stipulated in article 289 para. 2 of the Penal Code.
- Citizens R.K; K.S.; M.P.; E.S.; and I.U.; for the criminal offense "Abuse of office," as stipulated in article 248 of the Penal Code.
-As part of the investigations into this criminal case, Fier Prosecution Office has issued a restraining order for citizen L.Gj, which has been executed by the judicial police.
Similarly, Fier Prosecution Office has sought the imposition of precautionary measures with a restrictive and coercive nature, namely " Suspension from the exercise of a public duty or service" and "Prohibition of leaving the country," as provided for in articles 242 and 233 of the Code of Criminal Procedure, against the following individuals: 
-    Citizen R.K, holding the position of chief inspector at the Inspectorate of Territory Defense, Lushnja Municipality.
-    Citizens M.P, E.S, K.S, holding the positions of inspectors at the Inspectorate of Territory Defense, Lushnja Municipality.
-    Citizen I.U, holding the position of general inspector at the Administrative Unit No. 5, Lushnja Municipality.
Fier District Court has accepted the above mentioned requests from the prosecution, and currently, the court decision has been executed.
Subsequently, Fier Prosecution Office based on articles 28, point. 1; 75/a, letter "c," and 84 of the Criminal Procedure Code has declared its lack of subject-matter jurisdiction and has forwarded the case files to the Special Prosecution Office in Tirana, as the competent prosecution office due to the subject matter, to continue the investigations against citizen B.Ç, a member of the Albanian Parliament.
