Tirana Prosecution Office seeks ‘House Arrest’ and ‘Suspension of exercising a duty or public service’ for the IT Director because of exporting the TIMS database of the State Police

Tirana Prosecution Office seeks ‘House Arrest’ and ‘Suspension of the Exercise of a Public Duty or Service,’ provided for by articles 237, 242 of the Criminal Procedure Code for the citizen E.M, suspected of committing the criminal offense envisaged by article 192/b/2 of the Criminal Code "Unauthorized computer interference." 

The General Directorate of State Police has forwarded the procedural material registered under no.9866, dated 01.09.2023, for the criminal offense of "Abuse of Office," as well as "Unauthorized computer interference," envisaged by articles 248 and 192/b of the Criminal Code. Similarly, through the letter with prot. no.2482, dated 08.08.2023, the Police Oversight Agency has submitted the investigative material under No. 10898, dated 08.08.2023, for assessment.

Upon review of the submitted material, the criminal proceeding no.5404, dated 01.09.2023 has been registered. Subsequent to thorough investigation, citizen E. M. was under investigation and suspected for committing the criminal act of "Unauthorized Computer Interference," as stipulated in Article 192/b/2 of the Penal Code. 

Summary of the criminal investigation reveals that on the date of 02.08.2023, unauthorized access and export of data occurred in the State Police database located at the premises of the Directorate of Technology and Information at Rr "Mine Peza", Tirana, by the Director of Technology and Information, E.M. These actions took place late at night, involving unauthorized individuals entering the premises and logging in using the personal PIN of an absent employee, raising reasonable suspicions of improper and unlawful conduct.

The investigation of this criminal proceeding has been extended to questioning all persons involved on the day of the incident, as well as conducting relevant expertise. During the investigative process, verifications have been conducted regarding the credibility of the person under investigation, E. M, in relation to his position as Director of the Department for Technology and Information. The person under investigation, E. M., according to letter no. 3041/1 prot, dated 08.01.2024 from the Police Oversight Agency, is found to have been reported on 23.10.2007 in Italy as responsible for criminal acts of forgery committed by private individuals and the use of a false document. On 09.09.2008, citizen E. M. was notified of the decision to refuse the renewal of the residence permit issued by the police headquarters in Bari.

Following the criminal proceeding investigation,among other things,  it has been revealed that the individual under investigation serves as an external advisor to the Director of the State Cadastral Agency, concurrently holding the position of Director of the Department for Technology and Information in the State Police. The State Police Law prohibits secondary activities except teaching. However, the individual under investigation, E. M. did not declare this secondary activity in the application documents for the position of IT Director in the state police.
