“Illegal construction" and "Falsification of Documents"; Tirana Prosecution Office has seized the two-story villa in Petrela.

Upon request of Tirana Prosecution Office, the court decided to impose preventive seizure on the two-story building, with a sorrounding land of approximately 660 m2 in Kërrabë, Petrela, registered under the ownership of citizen Xh.Ç.. 

In 2023, criminal proceeding no. 504 was registered for the criminal offense of " Illegal construction" as provided for in Article 199/a of the Criminal Code, regarding the construction built by citizen Xh. Ç. on plot no. 2/a of the Forest Economy Krrabë, Petrela.

The ongoing investigation into unauthorized constructions has revealed interventions on plot no. 2/a of the forest economy 'Krrabë-Gurrë', including the construction of seven villa-style buildings with varying sizes, concrete structures, and roof and terrace coverings, contravening forestry legislation and territorial planning regulations.

Upon examination of the documents, it is evident that in addition to the criminal offense of "Illegal construction," there is also a potential case of "Forgery of documents" as stipulated in Article 186 of the Criminal Code. This conclusion arises from the Expertise Report dated 12.09.2022, which initially appears to have been issued by the Institute of Construction. However, based on the information gathered, this document does not appear to have been processed, as no corresponding action has been taken regarding citizen Xh. Ç.

Considering that the continuation of further construction aggravates the consequences and the fact that this construction has been built in complete violation of the law, including elements of the criminal offenses of " Illegal construction " and "Falsification of Documents" as stipulated in Articles 199/a and 186 of the Criminal Code, and  since falsified documents facilitated the issuance of permit by the Municipality of Tirana, we believe it imperative to impose preventive seizure under these circumstances.
