"Unifying decisions should treat the issue basically, not on specifically"

General Prosecutor, Mr. Adriatik Llalla, estimates the commitment of the Supreme Court for the unifying decisions on the cases of particular persons, which can be subject to interferences of different natures

General Prosecutor, Mr. Adriatik Llalla, is confident that the Supreme Court has the capacity to ensure the standardization of judicial practice in the Republic of Albania, but this can be achieved only through unifying decisions on issues in principle. At the meeting “Criminal trial and the unification of the judicial practice”, developed by the Supreme Court on Thursday (dated on 16.04.2015), Mr. Llalla said, among other that: “The lower level courts, often encounter problems which require interventions with unifying decisions. It was found that, in the vast majority of cases, the United Panels are engaged when the issues under discussion appear during a concrete trial case.

The Albanian Prosecution Office considers as important the Supreme Court interference with unifying decisions on issues in principle. In this way, the United Collages avoid different interferences to concrete cases. We all live in Albania, where the population number is small and the possibility of interferences of extralegal nature is considerable. For this reason, the Prosecution Office suggests that the United Collages should treat the cases before they are presented at the Supreme Court with concrete names of the defendants.
The following is the full speech of the General Prosecution, Mr. Adriatik Llalla:

A few weeks ago, at another meeting with the Supreme Court, the main actors of the justice system discussed about the importance of the unifying decisions. The Albanian Prosecution Office estimates as important this topic, in order to standardization of the judicial practice. Currently, a large number of institutions ate engaged to design the justice reform, which includes legal and structural interventions. All these amendments that are under discussion must go along with the application of uniform standards on the decisions of the court. Any good will would lose its value if in courts, the uniform standards and cases will be addressed in different ways.


In this regard, the Supreme Court has an important role to standardize the judicial practice. And, at the Prosecution office evaluation, the standardization of the decisions must initially be fully implemented in criminal panels at the Supreme Court and then to proceed further in lower level of the judiciary.

Criminal panels serve as a key barometer for the judges in the Republic of Albania regarding the decisions in cases against crime and corruption. For this reason, the judicial bodies of the Supreme Court should always keep in mind that their decisions have a direct impact on criminal policy in Albania.

Also, knowing that we have the consent of all stakeholders of the justice system, the General Prosecution Office considers it necessary to give its suggestions for the strengthening of the role of the United Panels on the unification of judicial practice.

The justice system in Albania has 20 years that makes progress, compared with its past. But we all are convinced that we still have a long way to fulfill the standards. Members of the Supreme Court have a great experience at the lowest level of the justice system and recognize the problems. So, we believe that they have the ability that the unified decisions to take on issues in principle and not to commit with proper names, because a dictated decision can directly affect the entire judicial system and continue to maintain a low perception on public of the justice institutions.
