Adriatik Llalla: Transparency, the basis of the rule of law strengthening

Having received the invitation of the School of Magistrates on the promotion of the Supreme Courts’ Decisions database over the years, I was curious to see its functioning and respective material.

I was really surprised given that the electronic research disclosed some cases examined in the highest judiciary level, which I had personally followed time ago in the first instance, and which details had faded out in my memory due to time and volume of the work over the years.

I want to express my personal appreciation and of the institution I represent for this project, which plays a primary role in the establishment of history in the Supreme Courts’ Decisions On the other hand, what I really consider as very important is the strengthening of the judiciary system transparency in front of the public opinion.

Legally, justice institutions express themselves only through their decisions and this has created the perception they are hermetic towards the citizens. Of course, this is not true, given that the Constitution of Albania has clearly provided that judiciary proceedings are open to public. This constitutes an additional value to the preservation of guarantees and rights of individuals in front of public institutions.

In order to change perception of institutions’ hermetism, the justice system itself should be more committed. And, of course, the data base being presented today is a positive signal in this direction. However, it is not the only one. Nowadays, the courts of the main judiciary districts are applying digitalised data systems for the judiciary sessions, which has influenced in the progressive transparency growth.

The General Prosecution itself is in the last stage of implementation of the electronic data system. Within few months this program will be implemented in several prosecutions and we believe that it will be functional in every link of the institution by the end of 2013.
The project to be used in the prosecution, offers at least two very important elements:

- first, it increases transparency of the institution;
- second, it maximally boosts the commitment of prosecutors of every level to implement the law with maximal correctness, since, through the electronic system, every decision-making of prosecutors will undergo at any time control of specialized structures in the General Prosecution.

These two aspects quoted above have one major goal only; strengthening of the public’s trust towards the institution of the prosecution.

Citizens demand justice and this is what we are prone to carry out. We will be able to accomplish this just demand of the public through maximal transparency only.
