Disciplinary measure "job position downgrade" to the prosecutor of the Kurbin Prosecution Office, Arben Nika
General Prosecutor, Mr. Adriatik Llalla, has accepted the proposal of the Prosecutorial Council for the job position downgrade of the prosecutor of the Prosecution Office Kurbin, Arben Nika, and decided the measure "transfer on the task of judicial police officer" for a period of 1 year as with his inactions has committed disciplinary violation of systematic investigations delays and bad performance.
According to the audit compiled by the Directorate of Inspection at the General Prosecution Office, turns out that the prosecutor Arben Nika has not given legal settlement to the charges assigned to him, according to the schedule provided in the instructions of the General Prosecutor No.241 on 21.11.2005 (as amended) and no.3 on 10.06.2012. While, for some predicate materials, has not entered into the record the criminal proceedings in fulfillment of the obligations deriving by the Article 287 of the Criminal Procedure Code.
Inactions of the prosecutor Arben Nika in the exercise of the function as prosecutor, according to Law no. 8737, dated 12.02.2001 "On the organization and functioning of the Prosecutor of the Republic of Albania", (as amended) constitute a disciplinary violation of systematic investigations delays and bad performance provided in Article 32, paragraph "b" of the law cited above.
